H-1B Rush Season Is Coming!


For the last three years, the H-1B visa cap has been met within the first days of filing. This year, USCIS will begin accepting applications on April 3, 2017 and it is expected that the cap will also be reached within the first few days of filing.

Here are the facts:

  • There are 65,000 H-1B cap-subject skilled worker visas up for grabs.

  • There are 20,000 H-1B cap-subject visas available for workers with a US masters or other advanced degree.

  • If USCIS receives more petitions than the cap provides visas, a random lottery will determine those petitions that are sent for processing.

  • Due to the high demand for skilled workers—especially skilled IT workers—it is likely that the cap will be hit within the first few days of filing, causing USCIS to process petitions via lottery.

Employers are advised to file their cap-subject petitions to be receipted on April 3, 2017.
